1.0 Contents of Rental

1.1. Power supply, power cord, laptop battery and carrying case are included in all laptop rentals, unless otherwise specified. It is the responsibility of the renter to care for and return all products listed above and all other specified items, or the renter will be charged for there replacement.

1.2. The Company assumes no responsibility for 'viruses' or the integrity of data of any hard disk, diskette, or other piece of hardware or software.

1.3. It is the responsibility of the renter to determine the hardware configuration needed to operate software and perform desired tasks. Upon providing the hardware as stated above in proper working order, the renter is obligated for full payment of rental term.

1.4. The Company shall have the right, without notice, to substitute any laptop of equal or higher technical specifications at no additional charge to the renter.

2.0 Shipping Charges

2.1. The Laptop Rental rate does not include shipping or delivery charges each way. The method of such shipping, delivery or return, is solely at the discretion of the Company. If renter ships or returns Laptop Rental by any other means without the prior consent of Instant Laptop Rental, renter shall be responsible for any charges or damages incurred.

2.2. It is the renter’s responsibility to notify the Instant Laptop Rental when the renter wishes to terminate the rental. Failure to do so will result in the renter being obligated at the prevailing rate for all charges until the laptop is returned.

2.3. Instant Laptop Rental offers FedEx 2-Day shipping for $20.00 per laptop and FedEx Overnight shipping for $45.00 (to be delivered by 11 a.m.) and $40.00 (to be delivered by 5 p.m.) per laptop. Instant Laptop Rental charges $20.00 per laptop for all return shipments.

2.4. The laptop must be returned in the original shipping box or laptop qualified box (available at FedEx), properly packed or the renter will be charged $25.00. Acceptance of the return of the laptop is not a waiver by Instant Laptop Rental of any claims that it may have against renter, nor a waiver of claims for latent damage to the equipment.

2.5. A service charge of $10.00 may apply when FedEx is called to schedule a pickup. If FedEx has a pick-up charge, the fee of $10.00 will be taken from the deposit before deposited funds are released. If a hold has not been placed on you credit card at the time of the laptop rental, Instant Laptop Rental reserves the right to charge your card for the $10.00FedEx pick up charge.

2.6. A $50.00 charge may apply if the Targus laptop carrying case is not returned.

2.7. Once the laptop has been delivered, the renter is responsible for the laptop until it is returned to Instant Laptop Rentals physical location or has obtained a FedEx receipt at the time of drop off.

3.0 Rental Term and Prices

3.1. Cancellation. Renter will be responsible for a cancellation fee of $25.00 or 15% of the initial rental fee, whichever is greater, once the rental agreement is signed or agreed to online and then not accepted. If the order has already shipped and is refused by renter the shipping fees will be added as well as the per diem rental rate for each day until returned.

3.2. Payment is due prior to the rental. Payment for additional time in excess of one month is due prior to the beginning of the following month or renewal period, whichever is sooner and the rate charged will be that of the initial period.

3.3. Extensions. If the renter wishes to extend the rental period, it is the responsibility of the renter to notify the Company in writing via email or fax 72 hours prior to the initial due date.

3.4. Security deposit. A deposit may be required on certain laptop rentals. Instant Laptop Rental has the right to request a security deposit. In the event the charge for the initial rental period selected does not exceed the minimum charge due, a deposit will be calculated and shown on the shopping cart at check out. The Company will reserve the deposit amount on the renter's credit card and will release the hold upon the return of the laptop. No charges for deposits will be applied to a credit card without making an effort to notify the renter.

3.5. The rental price does not include any sales or use taxes to the extent same are applicable.

4.0 Defect or Risk of Loss

4.1. Notice of defect. It is the renter’s responsibility to give written notice of defect within 24 hours of receipt of laptop. It is presumed by the Company that the equipment was delivered in good working condition and the renter accepts equipment for use unless notice of defects are made within 24 hours of receiving the laptop.

4.2. Loss. Renter shall bear the entire risk of loss or theft, damage or destruction for any cause whatsoever. In the event of loss or damage, renter will pay the retail list price of the equipment to Instant Laptop Rental.

4.3. Renter may not provide or engage a repair service for any equipment. All service will be done by Instant Laptop Rental.

4.4. Renter shall not make any modifications to the equipment or install hardware to the equipment.

5.0 Completeness of Agreement

5.1. This agreement represents the entire agreement between Instant Laptop Rental and the Renter for all transactions. No party is authorized to make changes without the express written consent of duly authorized officers of the Company. This agreement replaces all prior agreements, written or verbal between the Company and Renter.

5.2. If Renter defaults in any of the terms and conditions herein, or fails to make any one of the payments provided for herein, or if any execution or other writ or process shall be issued in any action or proceeding against renter, whereby the said equipment may be seized or taken or if a proceeding in bankruptcy, receivership or insolvency shall be instituted by or against renter or his property, or if renter shall enter into any arrangement or composition with his creditors, or in the event that any judgment is obtained against the renter, then and in any such event, Instant Laptop Rental reserves the right to obtain the laptop and pursue such actions to the fullest extent of the law.

5.3. Ownership of the equipment shall at all times remain with the Company. Renter agrees to pay all reasonable attorneys' fees and all costs incurred by the Company in protecting its rights or property under this agreement, or in suing renter for breach of contract. Renter hereby waives trial by jury.

5.4. Instant Laptop Rental will be responsible for maintenance of equipment, to keep equipment in proper working order.

6.0 Jurisdiction

6.1. This agreement shall be governed by the laws of the State of Texas. Renter irrevocably submits to jurisdiction in a state or federal court located in Harris County, Texas.

Instant Laptop Rental MAKES NO CLAIM OF MERCHANTABILITY, SUITABILITY, OR SERVICEABILITY FOR ANY EQUIPMENT RENTED. Any losses incurred for any reason attributable to the rental of the laptop are wholly non-chargeable to Instant Laptop Rental. Instant Laptop Rental shall not be liable for This includes but is not limited to loss of revenue (tangible or potential), loss of time, or rental charges paid or due, consequential, special or indirect damages.

Instant Laptop Rental is not responsible for any data stored on the laptop after its return. Rental waives any damages in the event Instant Laptop Rental fails to erase such data prior to rental of equipment to a subsequent customer.
